Billing Terms and Condition

1. USE OF OUR PLATFORM

1.1 By using our platforms, the customer agrees to be bound by the Terms & Conditions.

1.2 By submitting personal information, the information must be true, accurate and complete.

1.3 Our platforms may contain links or information on services to third party websites which are not operated by Beafoot. Beafoot have no control over and will not accept any responsibility and liability for the material on third party websites.

1.4 Product prices published on the platforms for customers from the United Kingdom are VAT included. Please review Article 3 Shipping for detailed information. The delivery costs applicable to your order will be clearly displayed at checkout before placing an order.

1.5 The customer is responsible for keeping personal information confidential. 

Please reach out to Beafoot Customer Service for any unauthorised use of the Beafoot Account or personal information.

2. ORDERS

2.1 By placing an order the customer agrees and understands that Beafoot may collect, use, store and process your personal information in accordance with our Privacy policy. Beafoot fully respect the privacy of individuals who access and use the platforms. Beafoot kindly refer the customer to the Privacy policy. 

2.2 Beafoot reserve the right to not deliver in case the stock level was incorrect at the time of receiving the order. Products in your basket are not reserved and can be purchased by others. Beafoot will do their best to remove any products with no stock. A delay occurs between the time by placing an order and the time when the order is accepted.

2.3 When the customer orders items via the webshop they make an offer to conclude a purchase agreement.

2.4 Although Beafoot try to ensure that all prices displayed are accurate, somehow errors may occur. If Beafoot discover an error in the price of a product Beafoot shall be under no obligation to accept or fulfil an order for this product at the incorrect price and reserve the right to cancel such an order that has been accepted or is in transit.

2.5 Cancellations may be due to any of the following reasons:

  • A product you ordered is out of stock
  • Beafoot is unable to obtain authorisation for your payment
  • Beafoot have identified an error with a product description, such as pricing error
  • The customer does not meet the eligibility requirements as specified in these Terms and Conditions
  • There is a system or procurement failure
  • The customer fails our customer validation checks
  • Beafoot discover that the customer is generating orders for commercial gain and not personal use

2.6 Beafoot reserve the right to cancel your order even after we have accepted it, for any of the reasons listed in article 2.5 of these Terms & Conditions.

2.7 Beafoot is not responsible for loss on addresses that differs from the billing address. It is the customer’s own responsibility. The customer agrees not to impersonate any other person or entity or to use a false name.

2.8 The customer agrees that the products will not be used for commercial purposes. The customer further agrees that Beafoot is not responsible for any financial or business loss.

3. PAYMENT

3.1 By placing an order, the customer authorise Beafoot to transmit information or to obtain information, which can be drawn from third parties from time to time. This may include verification checks involving your debit or credit card number or credit reports in order: 

a)To authenticate your identity 

b)To validate your credit card

  1. c) To obtain an initial credit card authorisation
  2. d) To protect you and Beafoot from fraud
  3. e) To enable Beafoot to arrange delivery of your order to your nominated delivery address

3.2 Beafoot offer the following payment methods:

  • PayPal

3.3 In case the customer chooses to pay for the order using a payment card with a currency denominated that is different from the currency published, the payment card will be charged in the payment currency at the foreign exchange rate applied by the card provider at the time when your order has been processed. Your international payment provider determines the foreign exchange rate which the customer will be liable to pay.

3.4 Beafoot use SSL encryption to protect your details. Potentially sensitive information such as name, address and card details are encoded so they can only be read on the secure server. This information is authenticated to ensure it only gets sent to this secure server and is checked to make sure it has not been tampered during transfer.

3.5 Security checks are also made on all transactions, to ensure the authenticity of each payment. As an extra safety measure, Beafoot only accept credit card payments with a 3D-Secure process via paypal to confirm the authorisation. 

3.6 A payment will be charged after a successfully placed order.

4. SHIPPING

Goods will be shipped double boxed and dispatched on working days from Monday to Friday. Due to Covid-19 delivery can run into unexpected delays which can take up to 7-10 working days.

4.1 The customer must provide Beafoot with complete and accurate delivery address information. This includes the name of recipient, email address, telephone number and delivery address. As a result, Beafoot is not responsible for the delivery of your order in case of inaccurate information.

4.2 Beafoot use DPD or DHL to deliver your parcel. Shipping rates can be found on the Shipping and Returns page. When the parcel is ready for shipment, Beafoot will send you an email with a Track & Trace code to follow your order process. 

4.3 Please note that if the customer decides to use any of our delivery partners’ personalised service, for example having your parcel delivered to a neighbour or left at a safe place. Beafoot is not held responsible for all orders which are lost, damaged or delayed.

4.4. Beafoot do not ship to collection points due to the high risk of fraud. The customer must change the delivery address on own request. In case of loss, Beafoot is not accountable on these occasions.

4.5 Beafoot is not responsible for any additional International Customs Duties and Sales Taxes on your order for shipment outside the United Kingdom. Please contact your local customs for an estimated rate.

4.6 Shipping duration on the Shipping and Returns page are only used for indication. There are no rights reserved for the published indications.

4.7 Delivery times may vary depending on the availability of the products. delivery times, including for same day shipment, are estimates only and cannot be guaranteed.

4.8 All online orders will be shipped, it is not possible to collect your order at our location.

5. DELIVERY STATUS

5.1 Beafoot will make every effort to deliver all orders within the published estimated delivery times. Due to inevitable factors and unforeseen events, Beafoot is not responsible for any delay or failure to deliver within the estimated delivery time frame. 

Please note that delivery of your order may take longer during Holidays, sale or other busy periods.

5.2 The customer will receive a Track & Trace code by mail once the package is ready to be shipped. The customer can track their order with the provided tracking number.

6. PRODUCT QUALITY & DEFECTIVE PRODUCTS

6.1 Beafoot attempt to be as accurate as possible in the description of the products published on the website. Beafoot cannot guarantee that all details are accurate and unflawed.

6.2 All product images on the website are for illustrative purposes only. The main purpose is to display colours accurately, however Beafoot cannot guarantee that your device displays the colours accurately. The pictures may differ from their actual colours. Beafoot cannot be held responsible for such discrepancy.

6.3 Beafoot check every product carefully with professionals before they leave the warehouse. However, in case of defective products, please get immediately in touch with our customer service for further investigation. Please note that Beafoot is not responsible for any damage inflicted during shipment.

6.4 During the shipment of goods, Beafoot can not ensure that shoe boxes arrive undamaged. Beafoot guarantee that all shoe boxes are original. Shoe models older than 2 years of release rarely have undamaged boxes. Beafoot always try to deliver shoe boxes in the most optimal condition. When placing an order, the buyer agrees to the risk that shoe boxes may be damaged. Returns regarding damaged shoe boxes will be voided.

6.5 It may happen that shoes are supplied with replacement boxes. Products in a replacement box will always be stated in the product description. Returns regarding replacement boxes will be voided.

6.6 Beafoot have no legal warranty period. This means that Beafoot do not offer legal warranty period of 6 months or 2 years.

7. RETURN & CHANGES

7.1 Customers have the statutory right to return the order, in original state with the Beafoot Tag attached, within 30 days after delivery.

The customer hold the right to return or change when the following requirements are met:

  1. The Beafoot tag must not be removed. Once the tag has been removed, all returns will be voided.
  2. The customer holds the right to open the package and check the contents. All products must be returned in their original and unused state. When traces of usage are visible, returns will be voided anytime.
  3. The product must be in original and brand-new state including tags, box and extras if applicable.
  4. All sales on Special Release Items are final. No returns or cancellation. Special Release items are marked with: ‘Special Release’.
  5. Businesses are not able to return goods.

The package has to be received by Beafoot within 14 days after delivery. Please check with your local shipping company for the duration of shipping.

Send the package double-boxed via registered mail. Beafoot is not responsible for any loss during the shipment.

We do not refund shipping costs.

All returns, which do not match with the requirements listed on the return form, are subject to a 35% penalty fee of the purchased amount or will be declined for return.

7.2 When the customer chooses to return an order through any other process, which is not outlined in these Terms & Conditions,  Beafoot shall refuse such discrepancy.

7.3 It is not always possible to stop an order from being dispatched. If the customer decides to cancel the order, which has already been dispatched, the customer needs to return the product within 14 days after receiving the order.

7.4 Beafoot may withhold any reimbursement until the order has been received.

7.5 Refunds will be issued to the customer as follows:

  1. a) If the return matches our requirements, it takes up to 10 business days before you can expect the reimbursement.
  2. b) Payments will be reimbursed with the same payment option the customer used.
  3. c) Orders paid with gift cards will be reimbursed with a giftcard worth the same amount.

7.6 Beafoot monitor the number of returns made by customers. Repeated returns will be flagged and may, at our discretion, be banned to future activities.

7.7 Businesses (B2B) do not have the right to return or exchange products ordered via the platforms. Businesses have no statutory rights to return orders. Sales to businesses are final.

8. DISCOUNT CODES & GIFT CARDS

8.1 Discount codes and Gift Cards are only given by Beafoot, discount codes given by other companies are not valid.

8.2 Gift Cards are valid for an unlimited time and can be used for a full or partial payment of your order at Beafoot. Discount codes are personal.

8.3 Discount codes and Gift Cards are not exchangeable for cash.

8.4 Under no circumstances Beafoot will be able to honour incorrect promotions and discount codes which are offered by third parties. Third parties are not affiliated with Beafoot.

8.5 Lost or stolen gift cards cannot be replaced, refunded, blocked or exchanged for a new Beafoot Gift Card.

8.6 Beafoot hold the right to remove Loyalty points or exclude members from the loyalty programme if there is a belief of misuse or when Beafoot discover a customer is generating orders for commercial gain and not personal use.

8.7 Beafoot Loyalty points are not exchangeable for cash.

9. USE OF CONTENT

9.1 All text, photographs, graphics, logos, artwork, sounds, music, videos, trademarks, user interfaces, visual interfaces and computer code belong to Beafoot. The content is protected by copyright, trademark and other intellectual property. No one is permitted to copy, reproduce, translate, transmit, republish, post, upload, distribute and publicly display in any way without Beafoot prior written permission. 

9.2 In case of interest to use some of Beafoot’s content on the platforms, please contact Beafoot before using the content.

9.3 No one must establish any link to the platform to suggest any form of association, endorsement or approval with Beafoot. The platform must not be framed or associated on any other site.
